User Terms
1. Do not install or use the App if you have not read and accepted these terms.
2. This application (the App) allows you to chat with Artificial Intelligence (AI).
3. You use the App at your own risk. Please make sure that your exploitation of the App is in compliance with local law. Please respect public order and personal privacy. You assume your full responsibility arising out of your use of the App and/or further sharing and distribution of any content you input or generate via the App.
4. We, AI COOL, grant you a limited, non-exclusive, non-transferable, non-sublicensable, non-assignable and revocable right to access and use the App.
5. Please respect our intellectual property rights to source code, UI/UX design, content material and trademarks.
6. Please respect intellectual property rights owned by third parties. YOU CANNOT USE ANY COPYRIGHTED AND/OR TRADEMARKED MATERIALS AS INPUT CONTENT.
7. The App integrates the following third-party materials:
OpenAI API (https://beta.openai.com/docs/api-reference), API terms & policies are available at https://openai.com/api/policies/service-terms/. When you share your User Content* you agree to comply with the terms of OpenAI Sharing & Publication Policy.
* User Content is any content generated by AI via the App, as well as your input content.
8. All rights not expressly granted herein are reserved.
9. You must be 18 years of age or older to use the App. If you are between 13 and 17 years of age you need to prove that you have your parent or guardian consent to use the App. You cannot use the App if you are under 13 years of age. 10. You are not allowed to upload or generate User Content that shows at least one on the following signs: is irreconcilable towards any identity; promotes hate or violence; implies harassment, threat or bullying; is meant for sexual services, contains description of sexual activity or is intended for arousing sexual excitement; celebrates the suffering or humiliation of others; contains unsolicited bulk content; attempts to generate malicious software; encourages suicide, cutting, eating disorders and other self-harming activity; produces provocative political statements or is intended for campaigning purposes; is false or misleading, attempts to defraud individuals or spread disinformation; may be considered illegal or inappropriate for other reasons.
11. You agree not to use the App in a way that is unlawful, illegal or unauthorized or that can harm anyone, i.e.: is defamatory of any other person, obscene or otherwise offensive; infringes any copyright, database right or trademark of any other person or entity; advocates, promotes or assists any unlawful act.
12. We are not responsible for the way you use the App. If your behavior is reported to violate these terms, we may take any legal measures pursuant to the applicable laws.
13. We may change or update the App without any prior notice.
14. All charges imposed by your communication services provider, including data roaming charges, are solely your responsibility. If you do not pay the bills related to your mobile phone or tablet device, then we assume that you have the permission from the person that does it before incurring any of these charges.
15. Please read our Privacy Policy carefully.
16. The App is provided “as is” and “as available”. We make no warranty that your access to the App or its functions will be uninterrupted or error-free.
17. If your use of the App caused violation of any kind, we assume no liability or responsibility for that. You are the one who shall be held liable for any breach of intellectual property rights of third parties or any other illegal/inappropriate action damaging a third party. You agree to hold harmless and indemnify us, our successors, assigns, licensees, partners, affiliates, officers, directors, employees from and against any and all claims, liabilities, complaints, losses, expenses and damages of any kind or nature arising out of your use of the App.
18. WE SHALL NOT BE LIABLE FOR DAMAGES WHICH OCCURRED IN RELATION TO PRODUCTS, SERVICES OR INFORMATION PROVIDED BY THIRD PARTIES.

User Content Terms
We do not claim any right or possession over your User Content (both input content and output content). It is you who retain all rights and bear all risks related to User Content, for the avoidance of doubt, you are responsible for all input content and represent and warrant that you have all rights, licenses, and permissions required to provide input content to the App. You are free to get any sort of benefit from the use of a digital version of User Content but first make sure that you are in compliance with the applicable laws. We encourage you to ensure that User Content either (a) belongs to you or (b) you have obtained the right to use it in the way you use it via the App. User Content should be legally and socially acceptable, it must never go against public order. User Content must not infringe any third party’s rights, including the copyright and the right to privacy. You acknowledge that output content may not be unique and other users may receive similar content from our App. Responses that are requested by and generated for other users are not considered your output content. You may not use output content to develop any artificial intelligence models that compete with OpenAI products and services. However, you can use output content to (i) develop artificial intelligence models primarily intended to categorize, classify, or organize data (e.g., embeddings or classifiers), as long as such models are not distributed or made commercially available to third parties and (ii) fine tune models provided as part of OpenAI services.
